Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your engagement with Kinarq ("Kinarq," "we," "us," or "our"). By engaging our services or entering into a project agreement with us, you agree to be bound by these Terms in full.

2. Services

Our services include but are not limited to:

  • Product strategy and market validation

  • Behavioral design and gamification systems

  • Experience design and UX research

  • MVP development (web and mobile)

  • Engagement optimization and analytics

  • Portfolio innovation partnerships

3. Project Terms

3.1 Proposals and Estimates

All proposals and estimates are valid for 30 days and are subject to change based on project requirements.

3.2 Payment Terms

  • 30-50% deposit required to commence work

  • Remaining balance due upon project completion

  • Additional work beyond agreed scope will be billed separately

  • Payment is due within 14 days of invoice date

4. Intellectual Property

4.1 Client Materials

You retain all rights to content and materials you provide to us.

4.2 Final Deliverables

Upon final payment, you receive ownership rights to the final deliverables, except for:

  • Third-party materials (fonts, images, etc.)

  • Our proprietary tools and processes

  • Open source components

  • General learnings used to improve future services

5. Project Management

5.1 Timeline

Project timelines are estimates and depend on prompt client feedback and approvals.

5.2 Revisions

Strategy and design projects include two rounds of revisions. Additional revisions will be billed separately.

6. Confidentiality

We maintain strict confidentiality regarding your business information and project details.

7. Project Termination

Either party may terminate the project with 30 days written notice. You will be billed for all work completed up to the termination date.

8. Warranty

We warrant our work to be free from defects for 30 days after launch. This warranty covers code fixes but does not include:

  • Content updates

  • New feature requests

  • Third-party service issues

  • Client-caused problems

9. Liability

Our liability is limited to the amount paid for services. We are not liable for any consequential damages or lost profits.

10. Changes to Terms

We reserve the right to modify these terms. Changes will not apply to existing signed agreements.
